Council Regulation (EU) 2024/1739 of 24 June 2024 amending Regulation (EU) No 269/2014

Regulation (EU) No 269/2014 will be amended to reflect the below changes amongst others:

Decision (CFSP) 2024/1738 adds a derogation for the release of frozen funds involving non-listed entities and banks. Clarifies that protection against liability for Union operators doesn’t apply if they fail to conduct appropriate due diligence using publicly available information.
Amends the circumvention provision to include activities where the person is aware and accepts the possibility of circumventing restrictive measures.
Introduces a way for Member State nationals and companies to seek compensation from Russian entities for damages due to restrictive measures.
Member States should report penalties for violating restrictive measures.
National authorities may consider voluntary self-disclosure of violations when applying penalties.
Ensures that documents related to enforcement and amendment of restrictive measures are protected to prevent undermining their effectiveness.
